1. Who we are

2. Scope

These Terms of Service apply to all orders placed through this store. By placing an order you confirm that you are at least 18 years old (or have the consent of a legal guardian) and that you accept these terms.

3. Products and cosmetic disclaimer

NIWA products are cosmetics, not medicines. They support the skin's own barrier; they do not diagnose, treat, cure or prevent any disease, and they are not a replacement for prescription treatment or medical advice. If you are pregnant, nursing, under dermatological treatment or have a known condition, talk to your doctor before use. Perform a patch test before first use and discontinue use if irritation occurs. Results vary from person to person; barrier repair typically takes 6–12 weeks.

4. Ordering and contract

Your order is an offer to buy. The contract is concluded when we send the shipping confirmation. We may refuse or cancel orders in cases of suspected fraud, pricing errors or stock unavailability; any payments already made will be refunded.

5. Prices and payment

All prices are shown at checkout in the displayed currency and include applicable product taxes where required by law. Payment is processed securely by Shopify Payments and the payment providers shown at checkout. We never see or store your full card details.

6. Subscriptions (Auto-Refill)

If you choose an Auto-Refill option, you authorize recurring charges at the interval shown at checkout until you cancel. You can pause, skip or cancel any time in your account or by emailing us; cancellation takes effect for the next unbilled renewal. We notify you before each renewal where required by law.

7. Delivery, returns and refunds

Delivery is governed by our Shipping Policy. Refunds, cancellations and our 90-Day Money-Back Promise are governed by our Refund Policy. Statutory withdrawal and return rights in your country remain unaffected.

8. Intellectual property

All content of this store — texts, photographs, graphics, logos and the NIWA brand — is protected by intellectual property law and may not be reproduced or used commercially without our prior written consent.

9. Liability

Nothing in these terms excludes or limits liability that cannot be excluded under applicable law (including for death, personal injury caused by negligence, or fraud). Otherwise, our aggregate liability arising from an order is limited to the amount you paid for that order, and we are not liable for indirect or consequential losses.

10. Reviews and user content

By submitting reviews, photos or other content to us you grant us a non-exclusive, royalty-free licence to use them in connection with the store and our marketing. We may decline or remove content that is unlawful, misleading or offensive.

11. Governing law and disputes

These terms are governed by the laws of the State of New Mexico, USA, without affecting mandatory consumer protections of your country of residence. Disputes shall be brought before the competent courts of New Mexico, USA, unless applicable law grants you a different forum. EU/UK consumers may also use the applicable online dispute resolution platforms.

12. Changes

We may update these terms from time to time. The version published at the time of your order applies to that order.
